These Terms of Service (“Terms”) govern your use of the websites, applications, eSIM platform, and services offered by Dejitech, Inc. doing business as Bcengi (“Bcengi”, “we”, “our”, or “us”). By accessing or using our services, you agree to be bound by these Terms.
If you are using Bcengi on behalf of an organization, you agree to these Terms on behalf of that organization.
1. Overview of Services
Bcengi provides access to global cellular data through digital SIMs (“eSIMs”) for individuals and businesses. Services may include data plans, self-service management portals, APIs, integrations, and reseller platforms. We may add or modify features at any time. Use of the services is subject to these Terms and our Privacy Policy.
2. Account Registration
To access certain features, you must create an account and provide accurate information. You are responsible for maintaining the security of your credentials and all activity that occurs under your account. For businesses and resellers, you may designate additional users or administrators, for whom you are also responsible.
3. Acceptable Use
You agree to use Bcengi services in compliance with all applicable laws and only for legitimate, authorized purposes. You may not: interfere with or disrupt the integrity or performance of the platform; use the service to send spam or for illegal activities; resell eSIMs in ways not permitted under your partner agreement (if applicable); or reverse-engineer, decompile, or attempt to access our source code. We reserve the right to suspend or terminate your access if you violate these terms.
4. Payments & Billing
Bcengi offers pay-as-you-go pricing for individual and business users. Payment is due at the time of purchase or top-up unless otherwise agreed in writing. Prices are listed in USD unless stated otherwise. All charges are non-refundable, except where required by law or stated in our refund policy. If using a third-party payment provider, you agree to their terms as well.
Prices are subject to change without notice. We do not guarantee that a particular price will remain available in the future, including rates for specific countries, data plans, or service tiers. Updated pricing will be reflected on the platform at the time of purchase.
Business users may access invoicing or prepaid balance options via the reseller or enterprise portal.
5. eSIM Compatibility
You are responsible for ensuring that your device supports eSIM technology. Bcengi does not guarantee compatibility with all devices, networks, or geographic locations. We provide compatibility tools and guidelines, but ultimate responsibility lies with the user.
6. Data Usage & Expiry
Your data usage is subject to the terms of the plan you select. In most cases: data does not expire unless specified; there are no rollover guarantees unless explicitly stated; and once consumed, your service may pause until another top-up is made. Resellers may configure different rules for their customers’ plans.
7. Intellectual Property
Bcengi and its licensors own all rights to the service, platform, software, and content provided. You may not copy, reproduce, or use our branding or materials except as authorized in writing. Reseller partners may use co-branding in accordance with their portal settings and partner terms.
8. Termination
You may stop using Bcengi at any time. We reserve the right to terminate or suspend your account for violations of these Terms; fraudulent, abusive, or unlawful behavior; or business, legal, or regulatory requirements. If terminated, you will lose access to remaining data balances and your account. No refunds will be issued unless required by law.
9. Disclaimers
Services are provided “as is” and “as available.” We do not warrant that the service will be uninterrupted or error-free, that connectivity will be available in all regions, or that eSIMs will be compatible with every device or carrier. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
10. Limitation of Liability
To the maximum extent permitted by law, Bcengi will not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities. Our total liability for any claims arising from your use of the service will not exceed the amount you paid to us in the past six months.
11. Indemnification
You agree to indemnify and hold harmless Bcengi, its officers, directors, affiliates, and employees from any claims, damages, or liabilities arising out of your use of the services or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey and applicable U.S. federal law, unless otherwise required by applicable consumer protection laws. Any legal action must be brought in the courts of New Jersey, unless otherwise required by law.
13. Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide notice by email or via our platform. Continued use of the services constitutes acceptance of the updated Terms.
